Do you need a contract for UGC videos?

You don’t legally need a formal contract for every UGC video, but we strongly recommend a written UGC contract before a creator films or you publish the content.

UGC feels casual, but it is still advertising, money changes hands, and your business is the one living with the fallout if a video gets pulled, a claim is challenged, or a creator later says you can’t use the clip in ads. A short agreement removes guesswork around rights, deadlines, payment, and disclosures.

When a contract is needed

  • You plan to run the video as a paid ad (Meta, TikTok, YouTube, Google).
  • The creator will post on their own account or you want whitelisting or Spark Ads access.
  • You want exclusivity, category limits, or any non-compete language.
  • You are in a regulated space like healthcare, dental, legal, financial, or supplements.
  • The video includes a minor, a customer, or anyone who is not your employee.
